Terms of Service – BidHaul LLC

BidHaul LLC ("BidHaul", "we", "us") operates the BidHaul online marketplace (the "Platform"). By creating an account or using the Platform, you agree to these Terms, the Privacy Policy, Refund & Dispute Policy, and SMS Terms.

1. What BidHaul Is

BidHaul is an online junk removal marketplace connecting customers with independent local haulers. BidHaul does not directly provide junk removal, hauling, labor, transportation, disposal, or cleanup services.

Haulers are independent service providers and are responsible for the work they perform, including proper disposal, transportation, labor, equipment, insurance, and compliance with applicable laws.

Customers post jobs, receive private bids, choose a hauler, and pay through BidHaul's secure payment system.

2. Payments Held

When a customer accepts a bid and pays, the payment is held through BidHaul's payment system. This does not mean the hauler has been paid yet.

Payment is held until the job is completed, reviewed, confirmed, or otherwise resolved under BidHaul's payout, dispute, refund, or admin review process. Customer screens describe this state as "Payment Held".

3. Hauler Payouts

Haulers are paid only after the job is completed and payout is approved or released under BidHaul's process. Haulers may be required to upload finished/completion photos before a job can be marked complete.

BidHaul may delay, hold, block, or review a payout if there is a dispute, refund request, missed deadline, fraud concern, payment processor issue, incomplete hauler payout setup, high-value review, or other support issue.

Estimated payout shown to haulers may include BidHaul fees, discounts, promos, or admin-approved fee adjustments.

4. Fees, Promos & Discounts

BidHaul may deduct a platform fee from completed hauler payouts. The standard hauler platform fee is 5% unless a promo, discount, or admin-approved fee adjustment applies.

Promo or discounted rates may be temporary and may have an expiration date. If a promo or discounted fee is active when a bid is accepted and payment is secured, BidHaul may lock that fee rate for that job. Customer pricing is based on the accepted bid amount unless otherwise stated.

5. Completion Deadlines

Customers may choose a completion deadline when posting a job. Options include:

  • ASAP — 24 hours
  • Within 2 days
  • Within 1 week
  • Pick a date
  • Flexible

The completion deadline starts only after the customer accepts a bid and payment is secured. The deadline does not start when the job is first posted. Flexible jobs do not have an automatic deadline timer.

If a hauler does not submit completion before the deadline, the customer may request a refund, extend the deadline, message the hauler, or contact BidHaul. BidHaul may review deadline-related refund requests before funds are returned.

6. High-Value Jobs Over $1,500

Jobs with accepted bids over $1,500 require BidHaul admin review before hauler payout is released. High-value jobs do not follow the standard automatic payout release timer.

BidHaul may approve payout, hold payout for more review, open a dispute, request more information, issue a refund, issue a partial refund, or block payout when reviewing a high-value job. Customers and haulers agree that high-value jobs may require additional verification before funds are released.

7. Customer Review & Release of Funds

After a hauler submits completion photos, the customer may be asked to review completion, release funds, report a problem, or contact BidHaul.

If the customer confirms completion, payout may proceed unless admin review, a dispute, refund request, fraud review, payment processor issue, or high-value review applies. After confirming completion, customers may be asked to rate the hauler.

8. Disputes

A customer may report a problem if the job is not completed, not completed as agreed, the hauler does not respond, or there is another issue. A hauler may also contact BidHaul if the customer is unavailable, the job is different than described, unsafe, restricted, or otherwise cannot be completed as posted.

When a dispute is opened, BidHaul may hold payout while reviewing the issue. BidHaul may review photos, messages, job details, customer and hauler notes, payment records, deadline status, and account history. BidHaul may approve payout, issue a full or partial refund, request more information, extend the deadline, or close the dispute.

9. Refunds

Refunds may be issued when BidHaul determines a refund is appropriate, including missed deadlines, non-completion, dispute resolution, cancellation, payment error, or admin review. Refunds may be full or partial.

Refunds processed through Stripe may take time to appear on the customer's payment method depending on Stripe and the customer's bank. BidHaul will not mark a refund complete unless the payment processor confirms the refund was created or completed. See the full Refund & Dispute Policy.

10. Cancellations

  • Customers may cancel a job before accepting a bid.
  • After a bid is accepted but before payment, the customer may cancel without payout.
  • After payment is secured, cancellation may require BidHaul review, especially if the hauler has started the job, traveled to the location, uploaded completion photos, or a dispute exists.
  • After completion is submitted, cancellation or refund requests are handled through the dispute or refund process.

11. Messaging

After payment is secured, the customer and selected hauler may message each other through BidHaul about the job. BidHaul may monitor, store, or review job messages for safety, support, dispute resolution, fraud prevention, and policy enforcement. Customers and haulers should keep job-related communication inside BidHaul whenever possible.

12. Address Privacy

Exact pickup address and customer contact details are hidden from public users and non-selected haulers. Before payment is secured, haulers may only see general location information such as city, ZIP code, and approximate map area.

Exact address and customer contact details are only shown to the selected hauler after the customer accepts the bid and payment is secured. Losing bidders and non-selected haulers do not receive the exact address.

13. Fraud & Self-Bidding

Users may not create fake jobs, fake bids, fake reviews, fake completions, or attempt to pay themselves through BidHaul. A user may not bid on, complete, or receive payout from their own posted job.

BidHaul may block bids, hold payments, hold payouts, suspend accounts, request identity or payment review, refund customers, or cancel jobs if fraud, self-dealing, payment abuse, stolen card use, chargeback risk, or suspicious activity is suspected.

14. Prohibited Items & Illegal Dumping

Customers may not post jobs involving illegal, hazardous, restricted, or unsafe materials unless specifically allowed by law and accepted by a qualified hauler. Examples include hazardous chemicals, fuel, paint, asbestos, medical waste, illegal items, biohazards, explosives, and regulated waste.

Haulers are responsible for proper legal disposal. Illegal dumping is prohibited and may result in account suspension and reporting to authorities.

15. Hauler Responsibilities

Haulers are responsible for deciding whether they can safely and legally complete a job before bidding. By bidding, haulers agree they can complete the job for the bid amount and within the customer's selected deadline after payment is secured.

Haulers must complete the job as agreed, upload finished photos, and communicate with the customer if there are delays or issues. Haulers are responsible for their own vehicle, equipment, labor, insurance, licenses, permits, disposal fees, taxes, and compliance with applicable laws. See the Hauler Terms.

16. Customer Responsibilities

Customers are responsible for providing accurate photos, job details, access instructions, contact information, and location information. Customers should not materially change the job after receiving or accepting bids without notifying the hauler and/or BidHaul. Customers must be available or provide access during the agreed completion window. See the Customer Terms.

17. Admin Control

BidHaul may review, hold, approve, block, refund, partially refund, or delay any payment or payout when needed for safety, fraud prevention, dispute resolution, legal compliance, payment processing, high-value review, missed deadlines, or support issues.

BidHaul may suspend or remove users who violate policies, abuse the platform, commit fraud, fail to complete jobs, misuse payments, or create safety concerns.

18. Stripe & Payment Processor

BidHaul uses Stripe or another payment processor to process payments, refunds, and hauler payouts. Payment processor rules, banking timelines, identity verification, payout availability, and disputes may affect payment or payout timing. Haulers must complete required payout setup before receiving payouts.

19. SMS Notifications

By opting in to SMS alerts, users may receive messages about bids, new jobs, payment status, messages, completion reviews, deadlines, disputes, refunds, payout status, and support issues. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help. Opting out of SMS may not stop important in-app or email notices. See the full SMS Terms.

20. Ratings & Reviews

After a completed job, customers and haulers may leave star ratings and reviews. Ratings must be honest and based on the actual transaction. Defamatory, harassing, or fraudulent reviews may be removed.

21. Limitation of Liability

To the maximum extent permitted by law, BidHaul shall not be liable for:

  • Property damage
  • Personal injury
  • Financial loss
  • Service disputes
  • Actions or omissions of any user

Use of the Platform is at your own risk.

22. Indemnification

You agree to indemnify and hold harmless BidHaul from any claims, damages, losses, or legal fees arising from your use of the Platform, your interactions with other users, or your violation of these Terms.

23. Modifications

BidHaul may update these Terms at any time. Continued use of the Platform constitutes acceptance of any updates.

24. Governing Law

These Terms shall be governed by the laws of the State of California.
