Terms of Service – BidHaul LLC

BidHaul LLC ("BidHaul", "we", "us") operates the BidHaul online marketplace (the "Platform"). By creating an account or using the Platform, you agree to the following:

1. Marketplace Platform Only

BidHaul is a technology marketplace that connects individuals seeking junk removal services ("Customers") with independent local service providers ("Haulers").

BidHaul does not perform junk removal services, does not employ Haulers, and does not control how services are performed. Customers choose which Hauler to hire based on bids and ratings.

2. Independent Haulers

Haulers are independent users and independent service providers. They are not employees, agents, partners, or representatives of BidHaul.

Haulers are solely responsible for their own services, pricing, scheduling, equipment, vehicles, insurance, permits, taxes, and lawful disposal of materials.

3. No Guarantees

BidHaul does not guarantee:

  • Service quality
  • Job timing or completion
  • Pricing outcomes
  • Reliability or conduct of any user

4. User Responsibility & Safety

Users agree to:

  • Provide accurate information
  • Comply with all local, state, and federal laws
  • Maintain their own safety, insurance, equipment, and permits
  • Not engage in fraudulent, illegal, or harmful behavior

Users are solely responsible for their own conduct, communications, transactions, and on-site safety.

5. Prohibited Items

The following items may NOT be posted, bid on, or hauled through BidHaul:

  • Hazardous waste
  • Chemicals
  • Asbestos
  • Biohazards or medical waste
  • Weapons or ammunition
  • Illegal materials
  • Anything requiring special licensing to transport or dispose of

Illegal dumping is strictly prohibited. Violations may result in account suspension and may be reported to authorities.

6. Payments & Fees

  • Posters pay only the accepted bid amount.
  • BidHaul deducts a 5% platform fee from completed hauler payouts.
  • Funds are secured through Stripe, a PCI-compliant payment processor.
  • Funds are held in escrow and released after job completion is confirmed or after admin review.

BidHaul is not a bank and does not hold funds for its own use.

7. Disputes, Refunds & Cancellations

  • Customers may cancel a posted job at no cost before accepting a bid.
  • If a customer cancels after payment but before service, or if the hauler cancels or no-shows, the customer receives a full refund through Stripe.
  • Customers may dispute completion before funds are released.
  • BidHaul admins may review evidence and issue a full refund, partial payout, or full payout based on the facts.
  • False disputes or platform abuse may result in suspension.

8. Ratings & Reviews

After a completed job, Customers and Haulers may leave star ratings and reviews. Ratings must be honest and based on the actual transaction. Defamatory, harassing, or fraudulent reviews may be removed.

9. Account Suspension

BidHaul may suspend or terminate accounts at its discretion for violations of these Terms, fraud, abuse, illegal activity, repeated complaints, or behavior harmful to other users or the marketplace.

10. Limitation of Liability

To the maximum extent permitted by law, BidHaul shall not be liable for:

  • Property damage
  • Personal injury
  • Financial loss
  • Service disputes
  • Actions or omissions of any user

Use of the Platform is at your own risk.

11. User Safety Disclaimer

Hauling involves physical labor and potential hazards. Users — both Customers and Haulers — are responsible for their own safety, the safety of their property, and compliance with safety laws.

12. SMS Notification Terms

BidHaul offers optional SMS notifications about job alerts, bids, messages, payments, disputes, completion updates, payouts, and account activity. SMS is provided through Telnyx.

  • SMS is opt-in. You must check the SMS consent box and provide a mobile number.
  • Message frequency varies based on your account activity.
  • Message and data rates may apply.
  • Reply STOP to any BidHaul SMS to unsubscribe.
  • Reply HELP for help, or email admin@bidhaul.net.
  • BidHaul does not sell, rent, trade, or share mobile phone numbers or SMS opt-in consent data with third parties for marketing or promotional purposes.

13. Indemnification

You agree to indemnify and hold harmless BidHaul from any claims, damages, losses, or legal fees arising from your use of the Platform, your interactions with other users, or your violation of these Terms.

14. Modifications

BidHaul may update these Terms at any time. Continued use of the Platform constitutes acceptance of any updates.

15. Governing Law

These Terms shall be governed by the laws of the State of California.
